About these terms
These terms apply when you buy from ELVA at elvaoral.com. ELVA is a UK business. You can contact us at jimmy@elvaoral.com. Please read these terms with our Refund policy, Shipping policy, Refill plan policy and Privacy policy, which form part of them.
Who can buy
You must be 18 or over and buying for personal use. We deliver to UK addresses only.
Our product
ELVA is a cosmetic moisturising mouth spray. It is not a medicine and is not intended to diagnose, treat or prevent any condition. If you have an ongoing dry mouth, speak to your dentist, doctor or pharmacist, especially if you take regular medication. Check the ingredients list before use. Stop using ELVA if you notice irritation or swelling, and contact us. Keep out of reach of children.
Your order
When you place an order, we'll email you to confirm we've received it. Our contract with you starts when we email to say your order has been dispatched. If we can't accept your order, for example because an item is out of stock or there is an error in the price, we'll tell you and won't charge you, or we'll refund you in full.
Prices and payment
Prices are shown in pounds sterling and include any taxes that apply. Delivery charges are shown at checkout. Payment is taken when you place your order.
Delivery
Delivery times and charges are set out in our Shipping policy. Responsibility for your order passes to you when it is delivered to the address you gave us.
Your right to cancel
You can cancel your order within 14 days of receiving it. For hygiene reasons, this only applies to bottles that are unopened and still sealed in their original packaging. How to return a sealed bottle is set out in our Refund policy. This is separate from, and in addition to, our 30-day guarantee on your first bottle.
Our 30-day guarantee
If ELVA isn't right for you, you can ask for a refund of your first bottle within 30 days of delivery, as set out in our Refund policy. The guarantee is limited to one per household.
The refill plan
If you join the refill plan, you agree to be charged each time a bottle is sent, as set out in our Refill plan policy. You can pause, skip or cancel at any time from your account. Cancelling stops future deliveries and charges.
Faulty or damaged items
Your rights under the Consumer Rights Act 2015 are not affected. If an item arrives damaged, leaking or faulty, email us within 7 days of delivery with your order number and a photo, and we'll replace or refund it.
Our responsibility to you
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care. We don't exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud. We are not responsible for losses that were not foreseeable, or for business losses.
Our content
The content on this website, including text, images and the ELVA name, belongs to us. You may not copy or use it without our permission.
Changes to these terms
We may update these terms from time to time. The terms in force when you place an order apply to that order.
Law
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
