Privacy policy

Who we are
ELVA is a UK business and the data controller for the details you share with us. Contact us at jimmy@elvaoral.com about anything in this policy.

What we collect

  • When you join our list (through the Better Nights Quiz, the Better Nights Guide or the founding list): your email address and your permission to email you. Your mobile number, only if you ask us to text you.
  • From the Better Nights Quiz: your age group, who the quiz was for, what matters most to you in a product, your taste preference and how you found us (for example, an advert). If you reserve a founding bottle, your first name, postcode and bottle choice.
  • Quiz health answers are never linked to you. Answers about how often you wake with a dry mouth, medication, the menopause, health conditions or what you use now build your result on screen. We also count them anonymously, without your name, email or anything else that identifies you, to understand what our readers need.
  • Testers (the ELVA Night Panel): if you apply, we ask about your nights, including health information such as medication, the menopause or a medical condition, only with your clear, separate consent. These answers are kept in a restricted file in our Google Workspace account, never in our email system and never used for advertising. Your name, email, postcode and application reference are kept in our email system so we can contact you about the panel.
  • If you buy from us: your name, delivery address, phone number and order details. Card payments are handled by Shopify Payments, and we never see your full card number.
  • How you use our site: collected through cookies only where you've agreed to them.

Why we use it
To send you emails and texts you've agreed to, which you can stop at any time. To tailor our emails to the preferences you shared. To run our tester panel, with your explicit consent. To deliver your orders and keep the records the law requires.

Who else handles it

  • Shopify runs our store and stores data in Canada and the United States.
  • Klaviyo sends our emails and texts and stores data in the United States.
  • Google (Google Workspace) runs our business email and stores Night Panel applications.
  • These transfers are protected by safeguards approved under UK data protection law.
  • Delivery companies receive what they need to deliver your order or tester bottle.
  • Meta receives information about visits to our site, and that someone has signed up, only where you've accepted cookies. Meta never receives your quiz or tester answers.
  • We never sell your details.

How long we keep it

  • Your email address and preferences: until you unsubscribe or ask us to delete them. If you haven't opened or clicked our emails for 24 months, we delete them.
  • Tester health answers: deleted within three months if you're not chosen, and when the test ends if you take part. Quotes you've given us permission to use are kept for as long as we use them.
  • Order records: six years, as tax law requires.

Adults only
Our quiz, tester panel and email list are for people aged 18 and over.

Your rights
You can ask to see the details we hold about you, correct them, delete them, limit or object to how we use them, or take a copy, and you can withdraw consent at any time. Email jimmy@elvaoral.com and we'll reply within one month. If you're unhappy with how we've handled your details, you can complain to the Information Commissioner's Office at ico.org.uk or on 0303 123 1113.

If we change this policy, we'll update this page and, if the change matters, tell you by email.
